You may use the Service only if you can form a binding contract with Company, and only in compliance with this Agreement and all applicable local, state, national, and international laws, rules and regulations. Anyone under 13 is strictly prohibited from creating an account for the Service. In addition, anyone under 13 may only accept invitations from parents / legal guardians to join their account.

CogCons may change the Service, stop providing the Service or features. We may even create usage limits for a Service in future. We may permanently or temporarily terminate or suspend your access to the Service without notice and liability for any reason. Upon termination for any reason or no reason, you continue to be bound by this Agreement. You are responsible for all the mobile data and battery usage resulting from the use of Service. We have no liability for your actions, such as sharing with unknown people or sharing with people who might harm you in any way etc, while using our services. You are solely responsible for your actions. We reserve the right, but have no obligation to monitor disputes between you and other users.

We are firmly committed to the security and protection of personal information of our Users and the Services. CogCons Privacy Policy describes how we collect, use, share and process personal information and you acknowledge and agree that CogCons may collect, use, share and process personal information as described therein. CogCons in no way is liable for any information, which might be in violation of the applicable law, provided by you or other users. CogCons shall also be not liable for any copy right infringement data, or any other data in any form which may be illegal for the platform, provided by you or any user. By entering any Personal Information, you accept the terms that you are solely responsible for the information provided by you, and you take up full responsibility of the consequences for any information provided by you.

Scraping of any information contained in the Services, by use of automated systems or software to extract data, including any Content and any third party information accessible via the Services, is strictly prohibited.

You may not use the Services in any way, which is illegal, harmful, or may be considered offensive by CogCons, third parties or other Users. You agree not to exploit the Services in any unauthorized way whatsoever, including but not limited to, trespassing or burdening network capacity. You further agree not to use our Services or Content in any manner to harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other user or users, and You acknowledge and agree that CogCons is not in any way responsible for any such use by You, nor for any harassing, threatening, defamatory, offensive or illegal messages or transmissions that You may receive as a result of using the Services.

You are not allowed to use the Services on any device that You do not own or control. You may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of CogCons software applications, any updates, or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or to the extent expressly permitted by these Terms or may be permitted by the licensing terms governing use of any open source components included in the CogCons software applications).

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CogCons MAKES NO WARRANTY OR REPRESENTATION, EITHER EXPRESS OR IMPLIED WITH RESPECT TO THE SERVICES, THEIR QUALITY, PERFORMANCE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF THIRD PARTY RIGHTS. THE SERVICES ARE PROVIDED “AS IS” AND YOU AGREE THAT THE SERVICES ARE USED AT YOUR OWN RISK.

You understand and acknowledge that the Services may be unavailable from time to time and that CogCons will not be liable for Your inability to use the Services for whatever reason.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU EXPRESSLY AGREE THAT CogCons SHALL IN NO EVENT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA AND GOODWILL, ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICES OR THE CONTENT, even if advised of the possibility of such damages. In particular, and without limitation, CogCons shall have no liability for any information stored or processed within the Services, including the costs of recovering such information. Your only right or remedy with respect to any problems or dissatisfaction with the Services, is to uninstall the CogCons applications and cease to use the Services. You can opt for Remove Account feature, where we delete all the information provided by you. You can also drop us a mail at connect@cogcons.com to Remove your Account.

CogCons SHALL NOT BE LIABLE FOR THE VALIDITY, RELIABILITY OR CORRECTNESS OF THE CONTENT AND INFORMATION PROVIDED THROUGH AND IN CONNECTION WITH USE OF THE SERVICES. ANY USE OF THE CONTENT AND INFORMATION OBTAINED THROUGH THE USE OF THE SERVICES SHALL BE AT YOUR OWN DISCRETION AND RISK.

Nothing in these Terms shall limit or exclude our liability for any liability that mandatorily cannot be limited or excluded by law, including any rights You may have as a consumer under mandatory consumer law.

CogCons may change the Services at any time, such as by adding or removing features or discontinuing the services. CogCons also reserves the right to modify these terms at any time by providing revised Terms within the Services. We always notify the User about the changes in Terms. You can opt to terminate the Services at any point of time if you are not satisfied with the Terms.

These terms shall be construed in accordance with the laws of India. You agree that any legal action or proceedings may may be brought exclusively in the competent courts/tribunals having jurisdiction in Bangalore, India and both CogCons and You irrevocably submit to the jurisdiction of such courts/tribunals.
